[#NoConsentNoTracking]
After the #RGPD, here are more things to contend with: the #DSA —Digital Service Act draft signed on January 20th:
► Targeted advertising aimed at minors will be prohibited (Art 24.1b). And it will no longer be allowed to use so-called sensitive data concerning adults. No more right to use sexual orientation or religion to recommend things to you. It’s already the case in Canada, and I thought it was under the GDPR... One of the proposed amendment was to ban all targeted advertising.
► Dark patterns will be banned. Whether it’s interrupting what you’re doing or giving more importance to the “accept” option than to the “decline” option. No more “as easy”? (Art 24.1a)
► Platforms will have to allow users to opt out of tracking. For example, be able to continue using a social network like Facebook even after disabling targeted advertising (doesn’t mean you’ll get fewer ads. . .).
► To put some pressure on moderation, a user will be able to claim compensation if he/she feels attacked by some content. That’s a big one!
► Algorithmic transparency: including the reason for targeting, who is behind an ad, specifically which product, etc. This is a provision in the newly enacted Bill 64 in Quebec. (Art 30)
