To the Digital Analytics Association Board of Directors. ▷ Given the mission of the DAA. ▷ Given its own Code of Ethics. ▷ Given its public nature. ▷ Given the global membership outreach. I publicly exposed the fact that DAA’s consent banner is not compliant to the GDPR regulation: ▷ Tracking is fired and cookies are set before consent is given; ▷ The consent banner itself, under the “Cookie Settings” option, defaults to all opt-in. I could have chosen to contact the DAA directly, but I decided to expose it publicly in the hope that it would send a simple message: ▶ It is not easy to comply and the DAA should go above and beyond to set an example. Instead of acknowledging the issue and offering a course of action, DAA’s reaction, through DAA’s head of ethics committee, attacked me personally and publicly. Former DAA Board Chair himself said this was a known issue for 18 months and, through a bit of humour (or maybe sarcasm), somewhat admitted nothing was being done to fix this. The way this was handled is absolutely unacceptable and reflects on DAA's reputation. I can only hope this would have been handled differently had it been anyone else exposing simple facts verifiable by anyone with a minimum level of knowledge of how digital marketing/martech/adtech works. Attacking a whistleblower is never the right approach and is not only shameful for those who act so belligerently, it is also very detrimental to the brand reputation and trust. The harm is done now. I offered to help but it was blatantly and openly rejected. As a former member, advocate, board member and treasurer, I sent a formal request to remove any and all contributions I have done to the DAA over the years. I expect the content to be updated within two weeks (July 13th at the latest). Furthermore, I will not contribute or support the DAA or any of its related activities ever again.
